Defamation

The Defamation Act 2009 defines a defamatory statement as “a publication, by any means, of a defamatory statement concerning a person to one or more than one person”.  A “defamatory statement” is defined as one “that tends to injure a person’s reputation in the eyes of reasonable members of society”.

What will be accepted by the Court as a defamatory statement will depend on the facts of the circumstances of the incident. Truth is a full Defence.

As such it is a good idea to discuss any possible defamation claim you might have with a Solicitor, who can advise of the risks involved.
